1. Acceptance of Terms

By accessing or using QRBloom ("the Service"), operated by QRBloom ("we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, you may not access or use the Service. We may update these Terms at any time by posting the revised version on this page with a new "Last updated" date. Your continued use of the Service after any such change constitutes your acceptance of the revised Terms.

2. Description of Service

QRBloom is a software-as-a-service platform that enables users to create, customize, manage, and track QR codes. The Service is offered in multiple tiers, including a free plan and paid subscription plans with additional features such as dynamic QR codes, scan analytics, custom styling, team collaboration, and API access. Feature availability is determined by your subscription plan.

3. Eligibility

You must be at least 16 years of age to use the Service. By using the Service, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

4. User Accounts

To access certain features, you must create an account using a valid email address and password, or by authenticating through a supported third-party provider (such as Google). You agree to provide accurate, current, and complete information during registration and to keep your account credentials confidential. You are solely responsible for all activity that occurs under your account. You must notify us immediately at support@qrbloom.com if you suspect unauthorized access to your account.

5. Acceptable Use

You agree not to use the Service to:

  • Create, distribute, or link QR codes to content that is illegal, fraudulent, defamatory, obscene, or otherwise objectionable under applicable law
  • Distribute malware, phishing pages, or any other harmful or deceptive content via QR codes
  • Infringe upon the intellectual property, privacy, or other rights of any third party
  • Circumvent, disable, or interfere with usage limits, rate limiting, or other security-related features of the Service
  • Attempt to access data, accounts, or systems belonging to other users or to QRBloom without authorization
  • Resell, sublicense, or redistribute the Service or access to the Service without our prior written consent
  • Use automated means (bots, scrapers, etc.) to access the Service except through our published API in accordance with its documentation and rate limits

We reserve the right to suspend or terminate your account and remove any QR codes that violate these Terms, without prior notice.

6. API Usage

If your subscription plan includes API access, you may use the QRBloom REST API in accordance with the published documentation and rate limits (currently 60 requests per minute). API keys are confidential and may not be shared or published. We may revoke API access at any time if we determine that usage violates these Terms or places undue burden on our infrastructure.

7. Subscriptions, Billing & Cancellation

Paid subscriptions are billed in advance on a monthly or annual basis through our payment processor, Stripe. All fees are stated in US dollars and are non-refundable except where required by applicable law. You may cancel your subscription at any time through the Stripe customer portal or by contacting us; your access to paid features will continue until the end of your current billing period. We reserve the right to change our pricing with 30 days' prior notice. Price changes will take effect at the start of your next billing cycle.

8. Free Plan & Fair Use

The free plan is provided for personal and small-scale use. We reserve the right to impose reasonable limits on the number of QR codes, scans, or other resources consumed under the free plan. QR codes generated on the free plan may include a QRBloom watermark.

9. Intellectual Property

Your content: You retain all rights to the content you encode in QR codes (URLs, text, contact information, etc.). By using the Service, you grant us a limited, non-exclusive license to store, process, and display your content solely to provide the Service.

Our property: The Service, including its source code, design, branding, documentation, and all related intellectual property, is and remains the exclusive property of QRBloom. These Terms do not grant you any right to use our trademarks, logos, or branding without prior written consent.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY DEFECTS WILL BE CORRECTED.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL QRBLOOM, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE, REGARDLESS OF THE THEORY OF LIABILITY. OUR TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE AMOUNTS YOU HAVE PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR ONE HUNDRED US DOLLARS ($100), WHICHEVER IS GREATER.

12. Indemnification

You agree to indemnify, defend, and hold harmless QRBloom and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Service; (b) your violation of these Terms; (c) the content you create or distribute through the Service; or (d) your violation of any rights of a third party.

13. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service ceases immediately. Sections 9 through 14 of these Terms survive termination.

14. Governing Law & Disputes

These Terms are governed by and construed in accordance with the laws of the State of New York, United States, without regard to its conflict-of-law principles. Any dispute arising under these Terms shall be resolved exclusively in the state or federal courts located in New York County, New York, and you consent to the personal jurisdiction of such courts.

15. Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and QRBloom regarding the Service and supersede all prior agreements and understandings.
